What Do You Need for Your Uncontested Divorce?

Prior to your meeting with our uncontested divorce attorney, you will want to gather the following information:

Personal Information

You will need to provide personal information for yourself and your spouse, including your full legal name, current address and other contact information, date and state of birth and Social Security number.

Where applicable, you will also need to furnish personal information for any minor or unemancipated children born during your marriage, born to you and your spouse prior to your marriage, or to wife with a third party during the marriage. This includes their full legal name, current address, date of birth, Social Security number, residence addresses and with whom they have resided for the last 5 years, and other details.

Allocating marital assets and debts is a sensitive aspect of a divorce, and thus it is a key element in any uncontested divorce checklist. In an uncontested divorce, parties come up with their own solution on dividing and allocating their assets. Typically, but not always, the allocation involves (a) keeping what you had prior to your marriage with you, (b) dividing any marital or joint property, and (c) making plans for the care of minor children or dependents in your household.

The Petitioner will be asked to provide a recent paycheck stub and fill out a Statement of Income and expenses detailing their typical monthly income sources and expenses such as mortgage or rent, utilities, car payments, and necessities such as food, clothing, entertainment, etc.

In addition, you will need to fill out a Statement of Assets and Debts detailing any ownership interest in any real estate, automobiles, watercraft, ATVs, bank accounts, investment accounts, retirement programs, life insurance policies, businesses, etc. We will need to go over whose name the property is recorded in, the estimated value or balance, whether the property is considered marital.

As you prepare your uncontested divorce checklist, you must also list your debts, including what the debt is for and in whose name, as well as the current balance and monthly payment. You and your spouse may have decided how you want to divide your assets and debts, whether there will be any spousal support, how to go about child support, and the manner in which you would like to pay attorney fees.
