What Does the Uncontested Divorce Process Look Like?

Step 1: Schedule a Consultation

If you want to move forward working with our team, then we will complete the intake process and collect your case information, which usually takes between 30 minutes to one hour. You will pay your attorney fee at this time.

Step 2: We Draft Your Case Documents

As the next step in the uncontested divorce process, we will draft and send your case documents to you for your review and approval. Your pleadings should be ready in about 3-5 days, sooner if your case is straightforward or a bit longer if it involves sizeable assets, premarital/post nuptial agreements, or other complexities. I work diligently to complete paperwork as quickly as possible.

Step 3: You Review and Approve the Documents

I can make as many edits to your case documents as you request. I am happy to answer any questions you may have on the documents. We work together to have everything the way you want it.

Step 4: Forward the Documents to Your Spouse

Your documents will need to go out to both parties for their review and approval. They may opt to have an attorney of their choice review everything prior to approval.

Step 5: You and Your Spouse Sign Documents

You may come in with your spouse, or separately.  We notarize both parties free of charge. Each party will need a photo ID. You will pay your case costs/filing fees at this time.

Step 6: We File Your Case with the Court

I can file the signed papers as early as the day on which you sign at my office, or I receive them.

Step 7: Wait the Mandatory 30-Day Minimum Waiting Period

Missouri mandates a 30-day waiting period before a divorce can be finalized. If you have children, you will complete your Co-Parenting Education Program during this time.

Step 8: We File Your Final Settlement Documents and Judgment

Upon filing your final settlement documents and judgment, the judge will review them and sign your Judgment of Dissolution of Marriage into effect. How soon depends on the judge’s schedule. It is not unusual to have to wait a couple of weeks after your minimum 30-day waiting period has passed. If you like, you can track your case status on Missouri Case Net.

Step 9: Your Case Is Complete!

Once the judge approves the terms you and your spouse have agreed on and grants the divorce decree, your divorce is complete and finalized. I will notify you immediately, and send you PDFs and hard copies of the final paperwork.
